General
Please take a moment and carefully read the Terms of Service below which govern your use of this website and its services. “Us”, “We”, “Our”, “DEFY”, “Defy Clan”, “The Community”, “website”, “services” all refer to DEFYclan.com as a group, as a community. By using our website or services you hereby agree that you accept all Terms of Service found on this web page as well as our Privacy Policy page, and any server specific rule pages. If you have any objection to any of these Terms of Service or our Privacy Policy, you must not use this website or its services.
Defy reserves the right to change or modify these Terms at any time without prior notice to you. We will change the “Last Revised” date when any change is made, changes will be effective immediately.
Accounts and Usage
Each user may only create and use one account on our platforms. Sharing accounts is not allowed. You are responsible for all actions taken on your account. Notify us immediately if your account becomes compromised. Do not create new accounts to circumvent a ban on any of our platforms. Any user with an active ban from any of our platforms agrees not to use or access the platforms they are banned from.
Content, Copyright, Licensing, and DMCA
Any audio, video, text, images or other content you choose to post on DEFY will remain your content, however you hereby grant DEFY (and its successors and affiliates) a worldwide, non exclusive, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, publish, and distribute it in any and all media. Content that you post must not infringe on any third party’s rights. DEFYclan.com reserves the right to remove any content at any time, for any reason, without notice.

We are not responsible for any messages posted. We do not vouch for or warrant the accuracy, completeness or usefulness of any message, and are not responsible for the contents of any message. The messages express the views of the author of the message, not necessarily the views of this website. Any user who feels that a posted message is objectionable is encouraged to contact us immediately by email. We have the ability to remove objectionable messages and we will make every effort to do so, within a reasonable time frame, if we determine that removal is necessary.
You agree, through your use of this service, that you will not use this website to post any material which is knowingly false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise violative of any law.
Personal Information
Sharing personal information of other users such as but not limited to real names, age, location, ip address, social media profiles, etc is not allowed. We also encourage every user not to share personal information for your own privacy and safety.
Behavior
We expect all users on all of our platforms to be mature, respectful, and above all keep it a fun/positive environment. Do not bring negative energy to our community. Defy does not tolerate any kind of hate, harassment, or discrimination. Do not attempt to play something off as a joke. Do not start or partake in any drama, rumors, propaganda, or any other controversial topics.
Reporting and Punishments
If you believe a player has broken a rule, please report it and let our staff team take care of it. Punishments will be issued on a case-by-case basis following our punishment protocol. We look at intent, severity, previous offenses, and more. We may issue anything from a verbal warning up to a Community Wide Ban. If you believe you were issued a punishment in error you may always discuss it with the staff member that issued it. However if the punishment sticks and you still disagree with it please submit an appeal. Flaming the staff member or causing a scene will only make it worse on you.
If a friend receives a punishment, do not speak on their behalf, cause a scene, or relay messages for them if they cannot do so themselves. We understand that as a friend you will defend them but creating a scene will only disrupt everyone else and likely wind up with you getting punished. Any punishment that is given should be discussed in private with the person that got the punishment and the staff member that issued it. Otherwise a punishment appeal should be submitted so management can review it.
Staff Encounters
If a staff member tells you to stop doing something then stop. Do not argue or let the heat of the moment get to you as that will likely just lead to further action taken on you. If you disagree with an action a staff member took you may appeal it. Otherwise if you feel that said staff member abused their power you may submit a report.
Community Wide Ban
In the interest of keeping the community a fun, safe, and friendly environment we may issue a community wide ban for the following reasons but not limited to: toxicity, consistent negativity, history of vac bans, discussing hacks, spreading rumors/drama/propaganda, knowingly providing a false statement. If you receive a community wide ban you must wait at least two years before you may appeal it, you may still remain banned even after submitting an appeal. Community Wide Bans are handled on a case-by-case basis.
Sales
Processing of your order may take up to 24 hours, after purchase. All sales are final, we do not offer refunds unless we deem you deserve one. Refunds will be based on a decision made there and then. Otherwise refunds are not available. Abusing any items or VIP purchased, could result in temporary or complete loss without refund. Purchasing VIP or any other item does not make you exempt from any server punishments, if it leads to a ban you will not be refunded. Certain items, features, powers, and packages may change with or without notice.
Contact staff through the support page(http://defyclan.com/support/) before requesting a refund or charging back. Failing to contact staff will likely result in a community ban.
Advertising
Discussing or linking to any other website, discord, teamspeak, or other community in our realm is not allowed. Self created content that you post that advertises is not allowed. Linking your Twitch or Youtube channel is allowed provided it complies with the above. If you would like to advertise on DEFY email [email protected].
External Links
For your safety we only recommend opening links that you recognize and trust. Anyone that sends a link with an ip logger will be banned and may even be community wide banned.
Limitation of Liability and Disclaimer
In no event shall DEFYclan.com owners or staff be liable for any direct or indirect damages of any kind. We do not provide any guarantee as to the performance or availability of any of our platforms.
